The lawsuit claims the house was illegally taken away by the city, which is in charge of the city’s housing services, when the city declared a housing emergency in December.
The city said the family’s home had been evicted for “substantial delinquent tax debt.”
The lawsuit claims they were living in an illegal residence.
The suit claims the city illegally entered the property without a court order, a violation of their constitutional right to be free from illegal search and seizure.
